Our gratitude to Purcell Murray
for hosting our June meeting.
This was the fourth meeting that they have
hosted for our Chapter. Thanks
also to
Larry Chatfield for his
informative presentation in regards to avoiding
costly installation
errors.
At our last meeting, the Board of
Directors passed two resolutions.
The first resolution was related to one of
our long standing Chapter members, Michael
Hamman. In recognition of
Michael's long history and involvement with NARI
and SFBA NARI, an honorary membership has been
given to Michael as long as he continues his work
in the remodeling
industry.

The second resolution related to
another long standing Chapter member, Everett
Collier, CR of Collier Ostrom Remodeling
Contractors, Inc. In
recognition of all the years that Everett has
served in many capacities as various Chapter
officers, including President, National President,
served on many committees, and who has worked
tirelessly for NARI, it was resolved that the SFBA
NARI Professionalism Award be renamed the Everett
J. Collier Professionalism Award, recognizing
Everett's long history and involvement with NARI
on the local and national
level.
Our congratulations go to Michael
and Everett for their long history, involvement,
and tireless work with NARI. We
are a much richer Chapter for having them as
members.
I am sure many of you have
received separate notices regarding the
proposed changes to the EPA's RRP
requirements. There was a
separate article posted in the Wall Street
Journal that represented how effectively NARI was able to poll
members and provide a compelling response.
By the time you have received this
Newsletter, our Chapter
and the North Bay Chapter will
have had the opportunity to meet with future San Francisco Mayoral
candidates as part of an event hosted by the
Pacific Contractors
Association. These are just
more examples of how NARI members can be involved
in the legislative process.
This year, the NARI National Fall
Business Meeting will be held in Newport
Beach, CA on October 5-8,
2011. This is a great
opportunity to learn more about the National organization
and to potentially get involved in many
of the activities that will be
taking place that weekend. We
will be providing future announcements
about the schedule, so stay
tuned.
We have another excellent program
scheduled for our Chapter Meeting on July 13 at
Urban Ore, where Jamie Christensen of
Deconstruction Appraisal Group will educate
our members on the benefits
associated with Deconstruction.
You will see firsthand the variety of
salvaged items that Urban Ore offers.
In other news specific to code
changes, effective July 1, 2011 ALL HOMES in
California will require CO alarms,
so plan accordingly.

Our
sincere thanks and appreciation to Purcell Murray
and Larissa Taboryski, Showroom and Culinary
Manager, for hosting our June Chapter
Meeting. The gorgeous showroom provided a wonderful
backdrop for our meeting and presentation.
We were served a delicious meal in
a fabulous environment. We had a
great group of over 40 in attendance.

Urban Ore is a 31-year-old reuse
business that began in 1980 by salvaging reusable
goods and recyclable metals at the City of
Berkeley landfill. Over the years, the company
moved its locations and unified its operations
first at Sixth and Gilman, and now at 900 Murray
Street, just off the corner of Ashby at Seventh
Street.

We are a supply-driven retail business
and occupy more than 3 acres with nearly all
secondhand goods. The outdoors Building Materials
department features a well-organized inventory of
windows; sinks; tubs; toilets; ceramics and stone;
pipe; lumber; and garden supplies. Inside the
33,000-square-foot warehouse are 22 categories of
doors; cabinets; a hardware department; furniture;
housewares; books; art, office supplies, and home
electronics; clothing; collectibles and jewelry;
and old gas stoves. We acquire materials by
salvaging at the City's transfer station; picking
things up in response to calls; and receiving
incoming materials from contractors and the
general public. We receive many things for free as
an environmentally friendly reuse disposal
service, although we buy some items for cash or
trade credit, typically paying no more than 20% of
anticipated sale price. Both sales and receiving
are open to the public 360 days a year.

Receiving closes at 5:00PM, and sales
continue until 7:00PM. Come to explore or shop. Be
sure to bring a truck!

Two
classes scheduled during July 2011
Since
April 22, 2010, general and painting contractors,
and property managers and landlords, engaging in
renovation, repair and painting (RRP) activities
must be "RRP Certified" and use lead-safe work
practices according to the law. This rule applies
to work that disturbs painted surfaces in
residential houses, apartments and child-occupied
facilities such as schools and day care centers
built before 1978.
Do
You Meet Certification and Training Requirements?
Firms
must have one or more Certified Renovators at the
job site supervising every day while the paint is
being disturbed. To be certified, a person must
successfully complete an EPA training course
conducted by an EPA-accredited training provider.
All
renovation workers must be trained. They can be
trained to use lead-safe work practices on the job
by a Certified Renovator if the work is not HUD
regu-lated, or they can become certified
themselves.
Firms
performing renovation, repair or painting (RRP)
work must also be certified. This can be
accomplished by applying to the EPA and paying a
fee.

WorkersNow - Pablo
Fuentes is the CEO and co-founder with Joe Mellin,
COO, of WorkersNow, a temporary staffing agency
that provides skilled tradespeople to building
contractors. Like other staffing companies, they
hire tradespeople and deal with the taxes and
insurance; what's different is the way they
communicate with workers and clients. WorkersNow
uses text messaging to broadcasts jobs, track
employees, and handle timesheets. Clients can view
and rate individual workers on the company
website.
A
member of SFBA NARI since 2010, Pablo joined our
Board of Directors early this year.
NARI is a way for him to connect with remodelers,
find out what they need, and let them know about
his company. His path to the construction industry
was nontraditional; a career in finance
followed by an MBA from Stanford, which is where
he and Joe came up with the idea for
WorkersNow.
When
Pablo is not working on the business he hangs out
with his girlfriend Noelle and his dog Coal.
He is also involved with a number of sports - as
he puts it, "kite boarding adequately and surfing
terribly". Pablo is currently training to
complete a 100-hour challenge with a group of
retired and active Green Berets in the Rocky
Mountains to raise money for the Green Beret

Small
Claims: The Trial
(Part
2)

In last month's article I
discussed the small claims court process and
procedures - preparing the complaint, filing it,
service, etc. (If you missed the article, please
visit SFBA NARI's website and click on the link
"In the News/Newsletter" under "For the
Trade.") What follows is a discussion of the
small claims hearing itself.
The
Small Claims Trial In General. It takes
place in a regular superior courtroom, but the
differences from a regular trial are
several. First, no attorneys are allowed to
represent parties (unless one is a party herself
or himself). Second - and more important to
you - most of the judges are not regular superior
court judges. They are older, experienced
volunteer attorneys who get a thrill from wearing
a judge's gown and pounding the gavel.
("Order! I will not tolerate any more
untowards behavior!") They may be probate
specialists, criminal defense attorneys, or in
personal injury. As a result, your
particular judge may not know a lot about breach
of contract and/or construction. That is why
I think the "small claims brief" discussed below
is an important tool for your success.
The
Hearing Itself. What if the other party does
not show up? Easy; you win as a matter of
course if your paperwork is in order.
It
is when the defendant does show up that you have
some work to do. And this is when a brief is
recommended.
The
Brief. A brief is a written statement
setting out the legal position of a party.
Here it should be short, about two or three
pages.
Your
small claims brief should have a brief recital of
the facts, a brief statement of relevant law, and
the attachments of documents to your case.
Theses attachments typically are the contract,
change orders, and invoices - and any collection
letters. Keep in mind that as the plaintiff
you have the "burden of proof." This means
you have to prove to the judge that it is more
likely than not that your version of the facts -
that you did the work, the work was fine, but you
were not paid - is correct.
Because
the judge frequently may not know much about
construction or contract law, the brief gives the
basic law and facts that he or she needs to render
a decision. Always bring three copies of the
brief and its attachments - one for the judge, one
for the defendant, and one for yourself.
While
a good idea regardless, it is when the other party
shows up that the brief is crucial. It can
be used as your script to explain to the judge
what has happened. It is also a way to get
your key documents (which are attached) to the
judge.
Since
you are the plaintiff, you get to go first.
("OK, Mr. Flutterblast, tell me what
happened."). What usually works is to hand
the judge a copy of the brief and say you would
like to briefly recite the facts. The judge
may or may not want you to; sometimes he or she
simply reads it and says "OK" - and then lets the
defendant talk.
Another
reason the brief is important is judges rarely
rule immediately from the bench when it is
contested. When he or she sits down later to
review the papers and decide the case, the brief
with its facts and documents makes it much simpler
to render an award for you.
The
Winner! Now What? Once you win, what do you
do? You should take your judgment and turn
it into an Abstract of Judgment. An Abstract
of Judgment is a fill-in-the-blank court form
which summarizes the court judgment and when filed
with the appropriate County Recorder's office
becomes a lien on the debtor's property. And
should the defendant debtor refinance or sell the
property, the judgment (with rare exception) must
be paid.
In
the meanwhile, the interest on the judgment is 10
percent per year. Judgments are good for 10
years and may be renewed prior to that for another
10 years.
