SFBA NARI embraces the entire
remodeling com-munity and provides members with
the benefits of a national organization dedicated

opportunities for enhanced profession-alism,
camaraderie, business growth, and success through
education, advocacy, networking, recognition and
promotion. We create opportunities to inform the
public about NARI through education-al activities,
community service, public relations and our

From Our Co-Presidents |

Our
Chapter's Leadership conducted a Strategic
Planning Meeting on January 15, which also
served as an introduction to new Board
members. Our thanks again to

Everett
Collier of Collier Ostrom, who presided as the
Facilitator during
the meeting. He did a
tremendous job of keeping the meeting lively
and
on track. The Chapter is
fortunate to be served by 19 talented Board
Members, 13 returning and 6 new, who represent a
great cross section
of our industry. They all brought fresh ideas and
energy to the meeting.
Our thanks for their involvement!
We
established 4 key goals for the 2011-2012 Chapter
fiscal year: 1) Raise
total membership to 140 members; 2) Increase
chapter awareness through
use of electronic

media;
3) Raise meeting attendance to an average of 40
per meeting; and 4) Increase committee
participation to 2-3 members for every
committee. Don't be surprised
if you find yourself contacted by a committee
chair!
Take
advantage of what your membership can provide by
getting involved.

professionally, from your
involvement.
The
January meeting was an excellent example of what
our Chapter can offer
its members. Thanks again to
our exceptional Moderator, Alf Nucifora, Chairman
of the Luxury Marketing Council, and the panel of
speakers, which included Contractors Steve Plath,
Plath & Company and Michael McCutcheon,
McCutcheon Construction and Interior Designers
Darlene Jurow, Jurow Design Associates, and Gioi
Tran, Applegate Tran Interiors, as well as all
those who were involved in orchestrating
this
event. These are the types of events that
strengthen our Chapter.
Let's
continue the support from the record-setting
January attendance and
plan on attending the February 9 Chapter meeting
at Zephyr Showroom in San Francisco. We
will learn directly from those most familiar with
the process on how to work successfully on City
projects, where there are remodeling opportunities
for
our members. We

Joint
Meeting Between SFBA NARI and the California
North Chapter of ASID A Rousing
Success

The
January 2011 joint meeting of SFBA NARI and the
California North Chapter of ASID was held at the
Tileshop in Berkeley. The event was a
rousing success. Attendance was at 100
people; it is the most that we have seen at a
Chapter meeting in a long time. It was a
complete sellout.
The
panel did a fabulous job in walking through the
process of a successful remodel from the point of
view of the designer as well as the contractor, as
well as remodels that did not go well and the
reasons why. The discussion was frank and
honest. The theme that resonated through the
panel was communication and how important
continued communication is between the designer,
contractor and homeowner.
Alf
Nucifora, Panel Moderator, did a wonderful job of
keeping the panel's discussion on point as well as
asking great and thought provoking
questions.
Rave
reviewes have been made all around; there has been
nothing but positive feedback, with people
wondering when we are going to have another panel
meeting.
Our
sincere thanks to Claudia Hacker of Tileshop and
her staff for being gracious hosts for this
meeting. Our dinner buffet was fabulous and
was enjoyed by all.

Speakers
George Bridges is a Senior Contract 
Compliance
Specialist with the San Francisco Redevelopment
Agency (SFRA). George has been with
the SFRA since 1998. In his position, he
administers and negotiates the SFRA's Program in
Economic
Diversity/Economic
Development and Small Business Enterprise in the
Mission Bay Project Areas. He also
monitors SFRA projects for compliance issues
regarding prevailing wage and workforce goals
and analyzes and evaluates statistical
information relating to the enforcement of
contract provisions.
George
received his BS in Marketing at Ohio State
University and is also a Certified Economic
Development Finance Professional and
a Master Compliance
Administrator.
Roberto
Lombardi is Director of Facilities at the San
Francisco Public Library
System

(SFPLS).
Roberto has been the Facilities
Director of the SFPLS since 2005. Prior to
joining the Library team, he worked
on a wide variety of projects, both in the
private and public sector, as a
carpenter, general
contractor, superintendent, and construction
manager. Projects he worked on ran the
gamut from custom remodeling and new homes, to
fire stations, historic buildings, schools, the
San Francisco City Hall, and Moscone West
Convention Center.
Roberto
currently lives in San Francisco with his wife
Laura, who is a civil engineer with the San
Francisco Department of Public Works, and two
daughters. | |

New
Laws for 2011

With the start of a new
year, contractors and fellow travels must be
mindful of the new and revised laws affecting the
construction industry.
Admittedly this is pretty dry stuff, but I
would recommend everyone take a minute to review
this information. And sorry to
say, but absolutely nothing got easier for
you.
Workers'
Compensation Enforcement Law - Tough
Love!
Effective January 1,
2011, the Contractors State License Board will be
allowed to issue "stop work" orders to any
contractor who fails to provide workers'
compensation insurance coverage for his or her
employees. (Oddly, this law
includes unlicensed contractors as
well.) Failure to comply with
the stop work order is considered a misdemeanor,
and punishable by up to 60 days in jail and/or
fines up to $10,000.
Employees affected by
the work stoppage would also be entitled to up to
10 days' pay for lost time.
Stop work orders take
effect immediately, but may be contested by
submitting a written hearing request within 20
days of issuance of the stop work
order.
So heads up on your
workers' compensation coverage.
It is a understatement to say that being
shut down will be catastrophic - particularly when
most lapses in coverage are bonehead failures to
take care of routine paperwork.
Mechanics' Lien
Changes.
Civil Code Sections
3084 and 3146 - I addressed this in a
previous article but it bears
repeating. The changes
stipulate the definitions of "claim of lien" and
"mechanics' lien" are the same. It
also requires that a Notice of Mechanics'
Lien be served on the owner and/or person
believed to be the owner of the property or on the
construction lender or original contractor, and
that a "proof of service
affidavit" to the above individual(s)
be completed and signed by the person serving the
Notice of Mechanics'
Lien.
Failure to serve the mechanics' lien and
confirm a proof of service affidavit will cause
the mechanics' lien to be void and
unenforceable.
Practice
pointer: Mechanics' liens just
became much more complicated.
While you don't necessarily need to talk to
your attorney (although we would be delighted to
hear from you), read the new requirements before
you record your lien.
Jobsite Safety - More
Tough Love!
AB 2774 -
Starting now, if an
employer has an injury in its workplace or even
allegations of a serious hazard, the Division
of Occupational Safety and Health (DOSH)
have clearer rules to make its
case. The purported core
principle of the new law is that a hazard posing a
risk of serious physical harm that is unacceptable
by modern standards should be treated as a serious
violation and penalized accordingly.
Major fines, such as $25,000, imposed on
employers are more likely to stick, and without
reductions.
In a nutshell, it has just
become easier for them to ding you - and for more
money! Be proactive,
preemptive, and keep those jobsites
safe.
License Fees to
Increase.
Effective July 1, 2011, a
new license fee structure will apply to those
renewing their licenses as well as new
applicants. For a listing of
the rate increases please the Board's website
www.cslb.ca.gov.
I won't bore you with the
Board's blurb - that it is entirely funded from
application, licensing, and renewal fees combined
with fines and penalties...and on and on.
Simply get out your checkbooks.
