More good
news!
In the third week after each quarter's
closing, the Remodeling Futures Program at the
Center for Housing Studies of Harvard University
publishes the LIRA. The LIRA is the Leading
Indicator of Remodeling Activity. According to the
latest report published July 15th, 2010, a
recovery in home improvement spending is to be
underway soon. The report shows growth and expands
to double digit by the first quarter of next

We have seen the LIRA predictions growing
since the low of -16.1% in the 2nd Quarter of
2008. Good news we can all live with.
Kudos and many thanks to DJ Mehler
Collections for hosting the July meeting. Good
food, good presentation by the panel and good
networking before and after the presentation. If
you missed the meeting, come to the August meeting
and hear about the news from the panel
discussion.
Our NARI California Coalition is having a
conference call this August 19th. We'll be
discussing the latest California legislation
impacting our Remodeling industry. If you have any
interest in legislation or government affairs,
watch for the notice in your email as to time and
the phone number to call.

heading up the Nominations Team for 2011. Be a

one-day Lead Renovator Training.

 This 8 hour course was
developed by the U.S. Environmental Protection
Agency (EPA), in collaboration with the U.S.
Department of Housing and Urban Development (HUD).
The class is designed to train contractors who
perform building renovations or repairs and,
painting and window contractors how to work safely
in housing with lead-based paint and comply with
EPA's Renovation, Repair and Painting (RRP) Rule
and HUD's Lead Safe Housing Rule. The course
addresses health concerns, regulations, before,
during and after work procedures, recordkeeping
and training non-certified workers.

Food and Crowds at the July
Meeting |

 The July Chapter meeting was
hosted by DJ Mehler Collections at their
very large and beautiful showroom at 165
Rhode Island in San Francisco. The
speakers Andrew Morrrall (architect), Linda
Herman (Linda Herman Consulting), Jeff Rexford
(Bashland Construction) and Susan Schindler
(homeowner undergoing an overbudget and stressful
whole house remodel) provided insight and ideas -
not necessarily agreement -about the construction
process and how to improve it. Ms. Schindler
presented her ten points, and the building
professionals responded.
Kim Northrop, Sales Marketing Director for DJ
Mehler, did a good job as master
of ceremonies. The audience
participated. Police were not called.
Over 50 guests, many new to NARI and
considering joining, enjoyed the give and
take, the food and the beautiful
venue.

Insurance Coverage Exclusions/Enforcement

Issues
In
a recent case regarding a homeowner/contractor
dispute, the claim was tendered by the contractor
to the contractor's insurance carrier. In response
to this tender, the adjuster handling the matter
stated that large parts (indeed, most) of the
claim were excluded from coverage by two specific
exclusions to the policy: the "subcontractor"
exclusion and the work product exclusion (or
"craftsman exclusion").
The "subcontractor"
exclusion usually states that a general contractor
must meet a number of requirements when dealing
with subcontractors, including: (1) there must be
a written contract with the subcontractor; which
includes a "indemnification/hold harmless" clause
in favor of the general contractor; and (2) the
subcontractor must be licensed and insured - and
name the general contractor as an additional
insured. (I will address the work product
exclusion in another article.)
With a big hole in the
insurance coverage (there was an offer by the
insurance carrier to pay the very limited
"covered" damages), this case will proceed to
litigation. And while insurance counsel will
probably be provided, the general contractor may
be stuck with paying the lion's share of any
damages.
Moral: Be aware of what is
and what is not covered by your commercial general
liability (CGL) insurance. While contracting with
a subcontractor, it is always a good idea that the
above requirements are met. But ask your broker if
they are mandatory in your policy!
Contractors
State License Board Enforcement
in
the Bay Area
As
I have mentioned in previous articles, the
Contractors State License Board is cracking down.
But this time, it is a good use of limited
resources.
In
April, the Board held a two-day sting operation in
Hayward, California. The Board's Statewide
Investigative Fraud Team (S.W.I.F.T.) and the
Alameda County District Attorney's Office
conducted a joint undercover operation. S.W.I.F.T.
was formed to crack down on unlicensed contractors
who avoid state and federal tax, employment, and
licensing laws. (It has made presentations to NARI
in the past.)
These
sting operations are targeted at unlicensed
contractors, with an emphasis on repeat offenders
and those who do not carry workers' compensation
insurance for employees. Other operations have
been held state wide in Sacramento, Santa Clara,
Sonoma, Los Angeles, Orange, and San Bernardino
counties.
Investigators
posed as homeowners seeking bids for construction
work from suspected unlicensed contractors. The
suspected violators were identified through online
and local advertisements. In total, 15 violators
were arrested for contracting without a license
and/or illegal advertisement - all misdemeanor
charges. Violators can face a maximum of six
months in jail and/or fines up to $5,000 for first
offenses. A second violation carries a mandatory
ninety day jail sentence in addition to fines up
to $5,000.

application, green remodeling guidelines, solar
applications, appliance selection and marketing a
green business.
